Terms of Service
The rules for using FaceBiometric — what we provide, what the institution is responsible for, and how the service, fees and data work.
Effective date: 16 October 2026 · Last updated: 16 October 2026
1. Agreement
These terms apply to the FaceBiometric attendance service — the kiosk app, the admin panel, the member portal, the API and this website. By using the service, the institution (college, school, hospital, company or other organisation) and its users agree to these terms. If the institution has signed an order form or agreement with us, that document applies first where it differs from these terms.
2. The service
FaceBiometric records attendance using face recognition on Android devices used as kiosks, and provides a web panel for dashboards, reports, leave, shifts, alerts, a member portal, integrations and privacy tools. Features available to an institution depend on its plan and on the features switched on for it.
3. Accounts and kiosks
- The institution decides who gets an admin account and what each person may see or change, and is responsible for actions taken with its accounts.
- Keep passwords, one-time codes, device IDs, device passwords and API keys confidential. Tell us promptly if you believe they have been misused.
- Each kiosk Device ID is meant for one phone. Replacing the phone requires unlinking it in the admin panel.
4. Institution's responsibilities
- Use the service lawfully, including India's Digital Personal Data Protection Act, 2023 and any rules that apply to the institution.
- Tell members what data is collected and why, and obtain valid consent before registering faces — from a parent or lawful guardian for anyone under 18. FaceBiometric provides tools to record consent; the decision and the duty to obtain it remain with the institution.
- Keep member details accurate and act on members' requests to access, correct or erase their data, using the tools provided.
- Offer another way to mark attendance to anyone who does not consent or withdraws consent.
5. Data and privacy
The institution owns the data it puts into the service and decides how it is used; FaceBiometric processes it on the institution's behalf, as described in our Privacy Policy. We do not sell the data or use it for advertising. The institution can export its reports and records at any time while it uses the service.
6. Acceptable use
Do not use the service to monitor people for purposes other than attendance and related administration, to collect data without a lawful basis, to break into or overload the system, to copy, reverse engineer or resell the software, or to upload anything unlawful. We may suspend access that puts the service, other institutions or people at risk.
7. Fees and plans
- Fees, the plan, limits (such as active members and kiosks) and the subscription period are as set out in the quote or order accepted by the institution. Taxes such as GST are extra where applicable.
- If fees remain unpaid after the due date and a reminder, we may restrict the service as described in the order — for example to a warning only, stopping kiosk uploads (scans stay saved on the device), or read-only access — until payment is received.
- Message charges of SMS / WhatsApp providers are paid by the institution to its own provider.
8. Third-party services
Some features use services chosen by the institution, such as SMS and WhatsApp providers or email accounts. Their own terms and charges apply, and we are not responsible for their availability or for messages they fail to deliver.
9. Availability and support
We work to keep the service available and secure, but it may occasionally be unavailable for maintenance or reasons outside our control. Kiosks keep marking attendance offline and upload when the connection returns. Support is provided by email on working days, or as agreed in the order.
10. Face recognition results
Face recognition is highly reliable but not perfect: lighting, camera quality, changes in appearance or misuse can affect results. The service provides tools to review scan photos, mark attendance manually and correct records. Decisions based on attendance (for example eligibility or salary) remain the institution's responsibility, and should allow people to point out and correct errors.
11. Suspension and ending
Either side may end the service as set out in the order. When it ends, the institution's data remains available for export for 30 days unless agreed otherwise, after which it is deleted from the service (backups are deleted on their normal cycle), except where the law requires us to keep it.
12. Ownership
The FaceBiometric software, apps, design and brand belong to FaceBiometric. The institution receives a right to use the service for its own attendance needs during the subscription; it does not obtain ownership of the software.
13. Warranties and liability
The service is provided with reasonable skill and care. Apart from what these terms or the order expressly promise, it is provided "as is". To the extent the law allows, our total liability for any claim relating to the service is limited to the fees paid by the institution for the service in the 12 months before the claim, and we are not liable for indirect or consequential losses. Nothing here limits liability that cannot be limited by law.
14. Changes
We may update these terms as the service or the law changes. The date at the top shows the current version; significant changes will be communicated to institutions in advance.
15. Law and disputes
These terms are governed by the laws of India. We will first try to resolve any dispute by discussion; if that fails, the courts having jurisdiction over FaceBiometric's registered office will decide it.
